1. GENERAL INFORMATION
In compliance with the provisions of Royal Decree 1906/99 of December seventeen, which regulates electronic contracting with general conditions, and the Retail Trade Regulation Act (Law 7/1996 of January 15, amended by Law 47/2002 of December 19) as applicable to the provisions on distance sales in articles 38 et seq.
This document constitutes the general regulation of the services provided by Themuneshop through the Website www.themuneshop.com , constituting the legal framework that develops the present contractual relationship of purchase and sale.
These General Terms and Conditions are subject to the provisions of Law 7/1988, of April 13, on General Terms and Conditions of Contract, Law 26/1984, of July 19, General Law for the Defense of Consumers and Users, amended by Law 39/2002, of October 28, transposing into Spanish law various Community directives on the protection of the interests of consumers and users, which incorporates the amendments introduced by Law 22/2003, of July 9, on insolvency, and incorporates the amendments introduced by Law 23/2003, of July 10, on Guarantees in the Sale of Consumer Goods, Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general terms and conditions, and Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, amended by Law 47/2002 for the transposition into Spanish law of Directive 97/7/EC, on distance contracts, and for the adaptation of the Law to various Community Directives and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
The services offered by Muné may be contracted by any users who meet the requirements established in these CONTRACT CONDITIONS and LEGAL NOTICE available at all times on the Website www.themuneshop.com .
2. SUBJECT OF THE CONTRACT
The purpose of this contract is to regulate the general terms and conditions of service offered by Muné. The services currently provided by Muné, and which are the subject of this contract, are those of a physical store and online sales.
Access to information is completely free, while the product purchase service is not free, with current product prices, shipping costs, and tax charges specified at all times.
The contracting procedure will be carried out in Spanish in all cases, although Muné may establish the possibility of carrying out the contracting of the service in other specified languages.
3. IDENTIFICATION OF THE CONTRACTING PARTIES

All data included herein has been entered directly by the CLIENT, therefore the responsibility for its authenticity lies directly and exclusively with the CLIENT.
4. OBLIGATIONS RELATING TO THE PURCHASE PROCEDURE
The CLIENT is solely responsible for the veracity of the data entered by him in the purchase procedure, and accepts the obligation to provide truthful, accurate and complete data.
If the CLIENT fails to comply with this obligation, they will be responsible for any damages caused to www.themuneshop.com or to a third party.
5. SERVICE CONDITIONS
The commercial terms of this service and any offers that may eventually be made by www.themuneshop.com They always appear on the Website so they can be consulted, archived or printed www.themuneshop.com reserves the right to modify these Terms and Conditions of Contract, as well as any other document displayed on the Website, at any time.
6. RESPONSIBILITIES
www.themuneshop.com will not be liable for delays or failures in accessing, operating, or using the website, or its services and/or content, nor for interruptions, suspensions, or malfunctions thereof, when these originate from breakdowns caused by natural disasters or situations of force majeure or extreme emergency, such as strikes, cyberattacks or intrusions, or any other situation of force majeure or fortuitous cause, as well as errors in data transmission networks, and in any case when the error has been caused by a third party unrelated to the business organization. www.themuneshop.com .
www.themuneshop.com is responsible for the reliability, truthfulness, and accuracy of the content, data, and information regarding the products offered on its website, unless these have been modified by third parties, whether or not affiliated with the organization, without the company's express authorization. The CLIENT agrees to comply with the provisions of the LEGAL NOTICE and the CONTRACTUAL CONDITIONS published by www.themuneshop.com on their website at the time of product purchase.
7. PURCHASE PROCEDURE
All products displayed on the Website www.themuneshop.com Prices are listed in EUROS and include 21% VAT in the price.

Currently, the service contracting process is conducted entirely electronically, and registration as a website user is required to begin. The steps to complete the contracting process are as follows:
1. Search for items - The store displays the item search bar on the left, where you can search for an item using the text entered in the form. The existing sections or categories are also displayed on the left margin. Clicking on a category will reveal its various subcategories in the center. Categories with subcategories are distinguished by their right-aligned subcategories or by ending with a minus sign (-). On each category or subcategory page, you will find products on sale or recommended items selected by Muné.
From this page, you can also access the list of all items in the current category, indicated by [Show more items]. Clicking on an item will take you to its individual product page, which contains detailed information, a photograph, and its price in euros. Some product pages may include a selector to choose different features or variations (color, size, etc.). Selecting these features may affect the price of the item, which will be displayed when selected.
2. Add items to your basket - To add any item to your basket, click the [buy] link or the shopping cart icon on the product page, the item's details page, or the category listing. - You can always view your basket by clicking the [view basket] link in the Mini Basket. The Mini Basket, which provides a summary of your basket's contents, is always displayed while browsing the store. Once in the basket, you can modify the quantity of an item, remove items, and view your order total. From the basket, you can proceed to checkout by clicking the [Proceed to checkout] link.
You can also add items to your cart from your personal "Your Orders" area, where your information and purchase history are displayed. Each listed order has a link that allows you to add the items from that order to your current cart, saving you time browsing the store if you need to repeat a previous order. Of course, you can make any necessary changes to your new order directly in your cart.
3. Log in - The next step is to log in with your email and password if you are already a Muné customer, or complete the customer form if this is your first time shopping in our store. Once logged in, you will see the screen with your billing and shipping information, the total cost of the items, the shipping costs (which you must select based on your shipping address), and your payment method.
4. Complete your order - Once you have verified that all the information is correct, you must click on the [Complete Order] button to confirm and close the order. After this, a screen will appear displaying the order number assigned to your purchase and other details.
8. PRODUCT SHIPPING
We usually have all the products we offer in stock. This allows us to process orders confirmed on weekdays before 2:00 PM for delivery the next business day (mainland Spain) via express courier. However, this depends on having expressly agreed upon with the buyer and is not a firm commitment on our part. It also depends on the order volume at any given time, and delivery of your order may be delayed by up to a week.
If you choose cash on delivery as your payment method, there will be an additional charge corresponding to the shipping company's commission, which is 5% with a minimum of €4 plus 21% VAT. Also, if you choose this payment method, we need to contact you by phone before shipping to verify your details. If we are unable to reach you, your order may be cancelled, or you must indicate this on our order form.
9. VALIDITY OF THE PURCHASE PROCEDURE AS PROOF OF ACCEPTANCE AND PERFECTION OF THE CONTRACT
Both parties expressly declare that acceptance of the service offer of www.themuneshop.com by the CLIENT, is carried out through the follow-up of the purchase procedure described in section seven, PURCHASE PROCEDURE of these contracting conditions.
Following all the steps described in section seven for the purchase of products and accessories by the CLIENT electronically implies full and express acceptance of these general terms and conditions of contracting, which is understood to be sufficient for contracting.
The contract will be perfected from the date on which the CLIENT expresses their agreement with the published contracting conditions, at the time of making the purchase, and must expressly select the acceptance thereof.
10. LEGAL RIGHT TO WITHDRAW FROM THE PURCHASE
10.1 . Right of withdrawal
If you are contracting as a consumer, you have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquired physical possession of the goods, or, if the goods in your order are delivered separately, 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquired physical possession of the last of those goods. To exercise your right of withdrawal, you must notify Muné of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or email) by writing to us at info@themuneshop.com or via our contact form. You may use the model withdrawal form, which you can download at the end of this section, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period expires.
10.2. Consequences of withdrawal
In the event of your withdrawal from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than our least expensive standard delivery option), without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction. You will not incur any fees as a result of such reimbursement. Notwithstanding the foregoing, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest. You must return or hand over the goods to us directly at the address above without undue delay and in any event no later than 14 calendar days from the date on which you inform us of your decision to withdraw from this contract. The deadline will be considered met if you return the goods before it expires. The cost of returning the goods will always be borne by the consumer, who may arrange this as they see fit. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
10.3. Contractual right of withdrawal
In addition to the legally recognized right of withdrawal for consumers and users, mentioned in this section, we grant you a period of 30 days from the Shipping Confirmation to return products. If you return the products within the contractual withdrawal period, but after the legal withdrawal period has expired, you will only be refunded the price paid for the products. You will be responsible for the direct costs of returning the product. You may exercise your right of withdrawal in accordance with clause 10.1 above. However, if you notify us of your intention to withdraw from the contract after the legal withdrawal period has expired, you must still return the goods to us within 30 days from the Shipping Confirmation.
Your right to withdraw from the contract applies exclusively to products returned in the same condition in which you received them. No refund will be issued if the product has been used beyond simply opening it, if it is not in the same condition as when delivered, or if it has been damaged. Therefore, please take care of the product(s) while they are in your possession. Please return the item using or including all original packaging, instructions, and any other accompanying documents. In all cases, you must include the receipt you received at the time of delivery, duly completed, with the returned product.
If you wish to return the products, you will be responsible for the return shipping costs. We recommend using the postal service as the easiest and most economical option. Please note that if you choose to return the items yourself with postage due, we will not accept the package.
After examining the item, we will inform you whether you are entitled to a refund. Shipping costs will only be refunded if the right of withdrawal is exercised within the legal period and all items included in the order are returned. The refund will be issued as soon as possible and, in any case, within 14 calendar days from the date you notified us of your intention to withdraw. However, we may withhold the refund until we have received the goods or until you have provided proof of return, whichever occurs first. The refund will always be issued to the same payment method you used for the purchase. If you paid by bank deposit, transfer, or cash on delivery, you must provide us with your bank account number so we can make the corresponding transfer.

11. PARTIAL NULLITY
If any part of these Terms of Service is found to be contrary to law and therefore invalid, this will not affect the other provisions that are in accordance with the law. The parties agree to renegotiate those parts of the Terms of Service that are found to be invalid and incorporate them into the remaining Terms of Service.
12. APPLICABLE LAW AND JURISDICTION
All matters relating to this Website are governed in all respects by Spanish law. Any dispute arising from or related to the use of this Website will be subject to the non-exclusive jurisdiction of the Spanish courts.
